Terms of Service

1. Agreement to Terms

By accessing or using ForwardChat, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services. ForwardChat is operated by Forward Genix (FGX Technologies PLT).

2. Service Description

ForwardChat provides AI-powered WhatsApp customer service automation. The service includes AI auto-reply, a conversation management dashboard, a business configuration panel, analytics, and related features designed to help Malaysian businesses manage their WhatsApp customer communications efficiently.

3. Eligibility

To use ForwardChat, you must:

  • Be a registered business operating in Malaysia
  • Be authorized to manage the WhatsApp Business number connected to ForwardChat

4. Account Responsibilities

  • You are responsible for maintaining the accuracy of your business information
  • You are responsible for the content configured in your business settings (menus, FAQ, auto-replies, etc.)
  • You must not use ForwardChat to send spam, illegal content, or content that violates WhatsApp's policies
  • You must comply with Meta's WhatsApp Business Policy and Commerce Policy

5. Payment Terms

  • Subscription billed in advance in Malaysian Ringgit (MYR). Monthly, quarterly, and annual billing cycles are available.
  • One-time setup fee charged at onboarding (where applicable)
  • Payments processed via bank transfer or online payment (details provided at onboarding)
  • Invoices are due within 7 days of issue. If an invoice remains unpaid after 7 days, service will be suspended automatically (AI responses stop, dashboard becomes read-only).
  • If an invoice remains unpaid for 30 days, the account will be terminated with no further charges. Data will be deleted as described in Section 6.

6. Cancellation

  • Monthly plans: Cancel anytime by contacting us via WhatsApp or email. Service continues until the end of your current paid month. No refund for partial months.
  • Quarterly / Annual plans: You may cancel at any time, but prepaid periods are non-refundable. Service continues until the end of your prepaid period.
  • Non-payment termination: If the account is suspended for non-payment and remains unpaid for 30 days, it will be terminated automatically with no further charges.
  • Your data will be retained for 30 days after cancellation or termination, then permanently deleted.

7. Service Level Agreement

  • Target uptime: 99.9% (excluding scheduled maintenance windows)
  • Scheduled maintenance will be communicated at least 24 hours in advance
  • Service credits may be issued for extended outages at our discretion

8. AI Disclaimer

  • ForwardChat's AI generates responses based on the business information you provide
  • The AI may occasionally produce inaccurate or unexpected responses
  • You are responsible for reviewing AI-generated conversations and correcting errors
  • ForwardChat is not liable for business decisions made based on AI responses
  • The AI does not provide medical, legal, or financial advice

9. Intellectual Property

  • ForwardChat and its underlying technology are owned by Forward Genix (FGX Technologies PLT)
  • Your business content and conversation data remain your property
  • We have a license to process your data solely for the purpose of providing the ForwardChat service

10. Limitation of Liability

  • ForwardChat is provided "as is" without warranty of any kind, express or implied
  • Our maximum liability is limited to the fees you have paid in the 3 months prior to the claim
  • We are not liable for indirect, incidental, or consequential damages
  • We are not liable for losses caused by AI-generated responses

11. Governing Law

These terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these terms or your use of ForwardChat shall be resolved in the courts of Malaysia.

12. Changes to Terms

We may update these terms from time to time. We will provide at least 30 days notice of material changes. Your continued use of ForwardChat after any changes constitutes acceptance of the updated terms.
